Definitions
- "Terms" means this Terms of Service agreement
- "You" or "your"means you, the user
- "Osmium", "we","us", or "our"means the Osmium service, operated by Red Software Solutions
- "Service" means Osmium's communication platform, including our websites and applications
- "Content" or "User Content" means anything you upload, post, or share on Osmium.
By using Osmium, you agree to these Terms and our Privacy Policy. If you don't agree, please do not use the Service.
1. Eligibility and Your Account
Age Requirements
You must meet the minimum age in your jurisdiction to use Osmium. In the EU, this is 16. If you are under the age of digital consent in your country, you must have permission from a parent or legal guardian.
If you misrepresent your age or otherwise provide false information, we may suspend or terminate your account.
Account Security
You are responsible for maintaining the confidentiality and security of your account. Notify us immediately if someone gains unauthorized access to your account.
2. What You Can (and Can't) Do
Using the Service
When you use Osmium, you agree not to:
- Post illegal, harmful, threatening, harassing, or defamatory content
- Share child sexual abuse material (CSAM) or content exploiting minors
- Engage in harassment, bullying, or hate speech
- Impersonate others or misrepresent your identity
- Send spam or unsolicited advertising
- Distribute malware or attempt unauthorized access to our systems
- Scrape data from the Service
- Violate intellectual property rights
- Engage in any illegal activities
Your Content
You own the content you post.
When you share content on Osmium, you grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, display, and distribute it.
You are responsible for ensuring you have the rights to everything you post.
3. Communities
Running a Community
When creating a community, you're responsible for moderating it and ensuring it complies with these Terms. We may remove communities that violate these Terms or pose risks to users.
Moderation
We use a combination of automated systems and manual review to moderate content. If your content is removed or your account is restricted, you may appeal the decision by contacting us at [email protected]. We will review appeals and respond within a reasonable timeframe.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, secure, error-free, or that data will never be lost.
6. Intellectual Property
Copyright Infringement (DMCA)
If you believe content on Osmium infringes your copyright, please contact our designated copyright agent at [email protected] with:
- Your contact details
- A description of the copyrighted work
- The URL or location of the infringing content
- A statement that you believe in good faith that the use is unauthorized
- A statement that your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
- Your physical or electronic signature
7. Legal
Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, data loss, service interruptions, or the cost of substitute services, even if we knew they were possible.
- Our total liability to you is capped at the greater of what you paid us in the past 12 months, or €100.
- We are not responsible for what other users do or post on the Service.
This does not affect non-waivable consumer rights under EU law.
Indemnification
You agree to indemnify, defend, and hold us harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any rights of others. This applies only where permitted by law.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement for general use of Osmium. If you use additional features, supplemental terms apply:
- API Terms of Use (if using our API)
- Payment Terms (if purchasing Paid Services)
Supplemental terms control only for their specific features. For all other matters, these Terms apply.
Governing Law and Jurisdiction
These Terms are governed by the laws of the Netherlands.
EU consumers may also rely on the mandatory protections of consumer laws in their country of residence.
Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, internet outages, or government actions.
Severability
If any part of these Terms is found invalid or unenforceable, the remainder remains in full force and effect.
No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
Survival
Sections concerning intellectual property, indemnification, limitation of liability, and dispute resolution survive termination of these Terms.
8. Changes and Contact
Updates to These Terms
We may update these Terms from time to time. We'll notify you of material changes via the Service or email at least 30 days before they take effect. Continued use after the effective date means you accept the updates.
If you don't agree to the updated Terms, you must stop using the Service and may delete your account.
